PRIVACY

1.       AUStrings will endeavor not to release any information collected about you to third party. AUStrings will not sell its database of customer details to a third party. AUStrings respects the right of users and will endeavor not to knowingly disclose user Identities unless direct by a court of law.

2.       You agree that AUStrings may report any outstanding debts past 60 days due, including full customer details to relevant credit agencies.

3.       AUStrings Privacy Policy is incorporated into this agreement to protect all customers.

CUSTOMER RESPONSIBILITY

1.       The customer must be over 13 of age. If the customer is under 18 years of age then a custodian must complete and be bound to this agreement as the responsible party for this contract in place of the customer.

2.       The customer warrants that at the time of entering into this agreement the customer is not relying on any representation made by AUStrings, which has not been stated expressly in this agreement, or on any descriptions or specifications contained in any other document, including any catalogues or publicity material, which were produced by AUStrings.

3.       The customer warrants that all details (including billing and contact information) provided to AUStrings is complete, current and accurate. The customer also warrants maintaining and updating this information as needed to keep it current, complete and accurate.

4.       The customer warrants the following:

a.       Will conduct such tests and computer virus scanning as may be necessary to ensure that data uploaded onto or downloaded by the customer from the Server does not contain any computer virus and will not in any way, corrupt the data or systems and network of any person.

b.       Keep any passwords used to upload data to the Server securely.

c.       Hold and will continue to hold the copyright in the Client Data, or are licensed and will continue to be licensed to use the Client Data.

d.       Keep up to date with the latest AUStrings news, updates and events. Systems and network maintenance as well as disaster events that occur will be posted on the AUStrings system news page.

5.       The customer accepts responsibility for all information and material that the customer issues over any Service, and indemnifies AUStrings and hold AUStrings harmless against any liability in relation thereto. In particular the customer would not publish or issue any information, which is illegal or defamatory. The customer also acknowledges that AUStrings does not vet or approve any information or material available through the Service. AUStrings do not accept any liability for any loss, claim or damages arising from or relating to information and material available through the Service, to the full extent permitted by law. Customers access and use such information and material at their own risk.

6.       The customer agree to abide by the Acceptable Use Policy which follows these Terms and Conditions and AUStrings Privacy Policy and the Customer agree that the terms of those two policies form part of this agreement between the Customer and AUStrings.

7.       The customer is solely responsible for dealing with persons, who access the Client Data, and must not refer complaints or inquiries in relation to such data to AUStrings.

8.       Any customers who resell our Internet services to others will fully comply with all applicable laws concerning the privacy of on-line communications. A customer's failure to comply with those laws will violate this policy.

9.       In accepting the services, you indemnify AUStrings for the violation of any law or AUStrings policy that results in loss to AUStrings or the bringing of any claim against AUStrings. If AUStrings is sued because of activities of a customer that violate any law, or this policy, the customer will pay any damages awarded against AUStrings, plus costs and reasonable Solicitor’ fees.

MISCELLANEOUS

1.       The Client grants to AUStrings a license to use and reproduce all Client Data in order to fulfill its obligations under this agreement. In this agreement "Client Data" means all information, data, text, logos, images, audio, movie clips and/or content in any form that forms part of the Client's web sites or emails.

2.       A provision of, or a right created under this agreement, may not be waived except in writing signed by the party granting the waiver, or varied except in writing signed by the parties.

3.       The law in force in New South Wales governs this agreement and the transactions contemplated by this agreement.

4.       Unless you are an authorized AUStrings reseller, you may not resell any AUStrings Services or assign your rights and obligations under this agreement without our prior written consent.

5.       AUStrings will not be held responsible for any personal injury incurred from the use of any AUStrings products under this agreement.
